Canberra loses its scourge of public service 'yes men'

Former Foreign Affairs Department boss Peter Henderson, who warned 20 years ago of the rise of the public service "yes men", has died in Canberra aged 87.

Mr Henderson, who was married to Sir Robert Menzies' daughter Heather, had an eventful career which included being sacked by Bill Hayden as departmental secretary and successfully suing another Labor figure who used parliamentary privilege to launch an attack on the former DFAT secretary's integrity.

He led the then Department of Foreign Affairs from 1979 until 1984.

The career diplomat, who led the then Department of Foreign Affairs from 1979 until 1984, was born into a Goulburn grazing family and served in a variety of foreign postings including Washington, Jakarta, Geneva, London and was head of mission in Manila in the days of husband-and-wife dictatorship duo Ferdinand and Imelda Marcos. He disliked imperial honours and radically changed staffing arrangements at Australia House in London to stop British-based staff looking at Australian-Eyes-Only material, and resisted pressure to make blatantly political appointments to plum diplomatic roles.

In his memoir, Privilege and Pleasure, Mr Henderson recounts how he baulked at one such attempt by then Labour Foreign Affairs Minister Bill Hayden.

"Neither Street, nor Peacock, nor Hayden until this time, ever made an appointment as unacceptable on professional grounds as this one," Mr Henderson said later.

When Hayden sacked Mr Henderson from his secretary's role in May 1984 in what is remembered as a spiteful effort, the minister insisted that it had nothing to do with Mr Henderson's connection to the Menzies family.

Mr Henderson never believed him.

After his "involuntary retirement," from the public service in 1985 Mr Henderson kept up an informed commentary on the state of the Commonwealth administration.

In 1987, he offered a prescient warning of "an increasing tendency towards the politicisation of senior ranks in the Commonwealth Public Service".

"If preferment is increasingly given to sycophants and yes men, and if people are increasingly pushed aside or discarded because they are known or suspected not to subscribe to the views of their political masters, the professionalism and quality of the public service as a whole can only suffer."

Mr and Mrs Henderson had four daughters, 11 grandchildren and three great grandchildren.

Mr Ball, a real-life Madison Avenue "mad man", who later devoted his life to public service, served as the National Capital Authority's chairman from 2006 until 2008 when he quit in protest to the newly elected Rudd government slashing the authority's staff and funding.

Mr Ball described the cuts as barbaric and lamented the loss of "Camelot", his name for an organisation with what he described as talented staff, money and vision for the national capital.

The former ad-man won widespread respect for his passion and advocacy for Canberra.

He died in Melbourne at the weekend, aged 80, after a long illness.

Former FA head condemns 'dumping'

The former Secretary of the Department of Foreign Affairs, Mr Peter Henderson, criticised successive Australian governments yesterday for using the diplomatic service as a dumping ground.

And he said the view expressed last week by Australia's Ambassador to UNESCO, Mr Gough Whitlam, that the US diplomatic service was handicapped by amateurs, applied also in some cases to Australia.

"The overseas service has been used as a depository for years by governments of all persuasions for people they want to get rid of in Canberra, and that I object to very much," Mr Henderson said.

Mr Henderson, who was with Foreign Affairs for 33 years, five of them as permanent head, left the Public Service last week after being offered the choice of a demotion or retirement.

He said he had been disappointed not to be offered the post of Ambassador to Washington, the most senior diplomatic posting.

"It wasn't as if I was being unduly presumptuous," he said.

"The three people who were head of Foreign Affairs before me went to Washington.

I don't think it was out of order for me to think I might be offered the same job."

The present Ambassador, Fraser Government appointee Sir Robert Cotton, is due to return soon, and it is believed he will be succeeded by a career diplomat.

Likely prospects are understood to include the outgoing Ambassador to Indonesia, Mr Rawdon Dalrymple, the Ambassador to the United Nations, Mr Richard Woolcott, the head of the department's executive, policy planning, defence and nuclear division, MrDuncan Campbell, and the deputy secretary, Mr Geoff Miller.

All four were considered candidates to succeed Mr Henderson as Secretary when he stood aside in September, but the job went to an academic, Professor Stuart Harris. Mr Henderson, 56, son-in-law of the late Sir Robert Menzies, finally left the Public Service last Friday, the day before he was named a Companion in the general division of the Order of Australia in the Australia Day honours list.

Under the Government's recently introduced "involuntary retirement" regulations, he received $52,700 - the equivalent of two months' pay for each year of service until he turns 60 - in addition to the usual superannuation benefits and pay in lieu of accrued leave.

Mr Henderson said yesterday that he had been faced with a choice of accepting an overseas posting, which he declined to name but which he said he had not been particularly attracted to, or staying on and working in Australia.

"I chose not to go to the post that was offered to me and, as to working in Australia, the choice lay between going down to the senior executive service or leaving as an involuntary retiree with $52,000," he said."I would prefer to leave and try to do something else than go and work in some lesser capacity in the Public Service."

Government sources maintained yesterday that the normal processes for department heads were followed when Mr Henderson was placed on the unattached list.

He had been offered a number of senior diplomatic appointments, including Ottawa, which would have enabled him also to retain the salary of a department head, but had declined.

The sources said the situation was not a question of Mr Henderson choosing either involuntary retirement or downgrading.

Being over the age of 55, he could have chosen to retire in the usual way, but the involuntary retirement provisions carried with them additional benefits and provided a more advantageous way to go.

The fact that previous heads of Foreign Affairs had been appointed to Washington did not mean that all subsequent heads were entitled to that appointment. Such appointments were a decision for the Government.

Mr Henderson chose not to comment yesterday on the present direction of Australian foreign policy saying he did not think it right "for public servants who have been right in the thick of it to make comments on Wednesday when they were on the payroll last Friday".

But he recalled the remarks by Mr Whitlam to the effect that the American diplomatic service was handicapped by having amateurs at the top.

Asked if he believed the same was true of the Australian service, Mr Henderson said, "I think there are cases when that has happened with us - yes.

He would say no more about any future job save that some people had talked to him but he had made no commitment of any kind.

I wouldn't feel free to comment until some further arrangements have been made." he said.

COMMENT
Looks like there was a massive post WWI development push in Australia, that was then put on pause by the Depression and what I assumed is preparation for WWII, between: 1930-1938.

As there is a body during the WWII period and thereafter: 1938–1957 (National Capital Planning and Development Committee (NCPDC)), it looks as though the Australians were confident of a US-Anglo allied capitalists win.

With the massive US-Anglo capitalist forces marshalled and sent to invade European soil (comprising an eventual 1 million allied foreigners on the Western European front in WWII), I guess there was perhaps reason to be confident.

The buildings I like best are circa the 1920s and 1930s.

Interesting comment about the state of the American capitalist diplomatic service of the day.  Obama's known for assigning political postings to his bundlers (electoral campaign fund-raisers), so at least part of the US diplomatic service must still be rather lame.

Don't know why I find that funny, but I do.  Even though I'm terrified sometimes.

It's hard to say what I'm more terrified of:  the potential of being random victim of politically motivated terrorism, or just your run of the mill everyday terrorism by hammer or machete wielding African gangs, committing violent dawn home invasions in packs, or committing carjackings, or committing tram hijackings, FFS.  

Well done, Australia.  Nothing like interracial gang home invasion to look forward to.  

Judging from the level of anger I'm feeling thinking about this right now, I'd say I'm more pissed about the gangs than I am about potential jihadis ... although I'm not real keen on the prospect of an encounter with the latter.

The actual existence of international treaties for assigning rights to alien invaders is about as ridiculous as having to chose between terrorism and totalitarianism.  

Where are the rights of the now stateless Europeans in all of this?   Yes, stateless.  Not a single European society has escaped from this criminal capitalist destruction.

The reactive dimension of global politics – at least at the level of many states – is a broader statement about how far things have rotted.  Nothing is more reactive than a State’s response to terrorism, actual or perceived.  The pure evidentiary dimension is neglected in favour of procedural fluff and unmeasurable contingencies. The box-ticking bureaucrat takes precedence over the judicial officer.

The Turnbull government has come down rather heavily in its response to a spate of attacks in France and Germany, deciding that it is time that something be done in the face of this supposed global madness.  The prime minister Malcolm Turnbull decided to press the issue in a letter to state leaders urging for the creation of a national regime to indefinitely detain terrorists even after the point of serving their sentence.

Civil liberties lawyer Greg Barnes has made the point that such assessments are fundamentally specious. They lack coherence, dimension and remain presumptuous.  The chances, therefore, of a person locked up for years on terrorist charges then engaging in acts of murderous mayhem on leaving, did not compute[comment:  I'd have to argue against Barnes on this.  Being locked up for years on terrorist charges may (or may not) be motive for acts of vengeance.  How likely that is, is impossible to say.  Most people would probably want to get on with what is left of their lives.  But you just don't know.  Who wants to take a chance?  On the other hand, who wants to incarcerate indefinitely and likely unjustly?  Again, this impossible choice is brought to you by INSANE POLICIES.  ]

The point is an ominous one for at least 13 prisoners convicted over what has been said to be Australia’s largest terrorism plot in New South Wales and Victoria.  After concluding their sentences, the individuals involved in the Pendennis network, led by Melbourne cleric Abdul Benbrika, would have little guarantee of release.  [comment:  wow, I didn't even know Australia had its own terrorist cell.  I tend not to follow much Australian news.   It annoys me more than other kind of news, so I sidestep it normally.  ]

Buttering in the face of such extralegal nonsense is always deemed necessary.  The Commonwealth Attorney-General George Brandis explained over the weekend that, “All of the attorneys, as the first law officers of our respective jurisdictions, understand the gravity of the threat that terrorism poses to Australia and its people.”[1]

What Brandis fails to mention is that such officers also owe it to the legal profession, its servants and the citizens of a country, to reassuringly ensure that liberties are not unduly tarnished, let alone entirely abandoned, as is being suggested by these measures.  The insolence of office, one so gleefully embraced, comes to mind.

With that merry insolence, the views of such officers are indifferent to habeas corpus, and the notion that a person who does time has (and here is a novelty), actually discharged the burdens placed upon him for such offences. Terrorism is simply being rendered, rather nonsensically, exceptional, an offence that demands special treatment.  [comment:  the problem is that politically motivated terrorism *is* exceptional.  Thanks again, politicians and liberal assh*les.  ]

If detention were to be infinite, the hierarchy of punishment would have to be abandoned in favour of an arbitrary notion of convict and permanently incarcerate if you can.  This would effectively eliminate the notion of sentencing as having any value bringing, instead, the fictional notion of a hypothetical terrorist attack to the fray[comment:  this is a hard one.  Nobody wants to be the cuck that leaves themselves open to terrorism.  Oh, wait.  The horse has already f*cking bolted because these Aussie cucks have done just that.  Now it's a choice of terrorism (or potential terrorism) or totalitarianism.   What's it gonna be?]

Instead of expressing outrage at the heavy-handed, not to mention clumsy approach of the Commonwealth government, the NSW Attorney-General Gabrielle Upton, congratulated Turnbull “on this initiative.  The stakes are high for NSW: make no mistake.  We have more people in our prisons than any other state that would be subject to these laws.”[2]  All the more reason, one would have thought, for not endorsing such regulations.  [comment:  OMG.  Sydney is Terrorist Central. ]

Upton’s shoddy reasoning pivots on mere words: “terrorism” qualifies for blanket imprisonment and detention.  Terrorism posed such a risk to the community it meant that no one could be “complacent”.

The situation becomes even more peculiar given the observations by such individuals a Greg Moriarty, national counter-terrorism coordinator and evidently self-proclaimed amateur penologist.  All agencies in the business of “national counter-terrorism” were “committed to preventing people from becoming terrorists; to disrupting and diverting people who are heading down a path towards violent extremism; and to rehabilitating people who are convicted for terrorism offences.”

But for all such noble ventures, there would always be those eggs that would stay rotten, where it was “not possible, or where there are significant areas of doubt”.  This mealy-mouthed assertion is a neat illustration about executive paranoia, enabling people to be detained at the pleasure of the sovereign.  [comment:  where can people go to escape this ugly bind?  There is nowhere among European civilisation that this has not been replicated by the assh*le nation destroying capitalists. ]

In Australia’s legal soil, noxious precedents flower that enable the Attorney-Generals at all levels of government to push for an agenda hostile to the detainee.  In mental health administration, there are those permanently kept away from trial (and hence a genuine testing of their cases) for reasons of psychic disturbance. [comment:  this gets worse and worse.  Again, what do you do?  Let disturbed ppl into the community or let potential terrorists into the community ... Oh, wait.  They have.  Assh*les. ]

The High Court has also done its bit to add to the regulatory framework of indefinite detention by arguing that stateless individuals can be indefinitely kept at the discretion of the State, a sort of administrative purgatory where risk from the detainee might manifest.   The case of Ahmed Al-Kateb remains something of a nightmare in that regard, an outcome premised on the shallow notion that non-judicial detention is entirely permissible provided it be for the purposes of removal.[3]  [comment:  thank f*ck the High Court is arguing in favour of something sensible.  What else are you supposed to do, in the circumstances?  Non-judicial purposes of removal sounds good to me.  ]

There was just one problem for Al-Kateb: his argument that any detention could not be lawful if it has ceased to have a valid basis for removal from Australia was dismissed with more than a bit of contempt.  [comment:  being convicted of terrorist plotting sounds like a good start to a 'valid basis' for removal to me.  I'd add rape, home invasion, carjacking and more to that list of everyday terrorism. ]

There are also those deemed genuine refugees under the United Nations Refugee Convention who are not permitted out of Australia’s brutal detention regime because they have been assessed, courtesy of the domestic espionage network ASIO, as a security risk.  All that, despite having no formal charges level.  The proposed change by Turnbull, to that end, remains dangerously, and lamentably consistent with enlarged and unaccountable executive power.   [comment:  thank f*ck for ASIO.   Who gives a sh*t about 'formal charges', invader rights and the status of those seeking to invade under illegitimate international treaty.  Only a suicidal liberal cuck would give a sh*t about technicalities of the fraud that is the nation destroying post WWII 'human rights' rort.   ]

A former refugee who allegedly raped a woman he met on Tinder has been granted bail.

It's alleged the Brisbane man raped the woman last week after meeting her online on Tinder and dating site Plenty of Fish.

He has been charged with four counts of rape, all relating to the same incident.

Police opposed a bail request from the man, a political refugee from the Middle East who spent two years on Christmas Island before arriving in Australia, on the grounds he was not an Australian citizen and could be a flight risk.

But defence lawyer Nic Tobin told Brisbane Magistrates Court the 26-year-old man was a permanent resident and was employed.

He also said the four counts of rape against the man related to a 'relatively tenuous consent issue case'.

'Consent will be a real, live issue in this case,' he said.

Magistrate Bronwyn Springer granted the man bail and ordered he undergo a disease test.

But she decided against imposing a condition that he not access dating sites and apps like Tinder on the grounds that such orders were often 'problematic' and because there was no evidence the man had committed any other offences linked to similar sites.  [comment:  how many women have to complain of getting raped before the 'problematic' condition of stay the f*ck off dating sites and apps is ordered by the piss weak Aussie courts, I wonder? ]

The case was adjourned until August 15.

    Police are warning home-owners not to arm themselves and therefore not to defend themselves against out of control African home invasion and violence, where the public are sitting ducks, and the police have been under-funded and are under staffed by 15 years in Victoria, thanks to the same scumbag politicians that implement the enforced invasion program.
    In addition, there is NO LEGAL CONSEQUENCE FOR TERRORISM COMMITTED BY AFRICAN GANGS.
    Sentencing is light; offenders have nice holidays in juvie, if convicted; uppermost home invasion tariff is grossly disproportionate for the nature of the crime (couple of years of being treated with the utmost of care in an Aussie taxpayer funded hotel); offenders dealt with leniently & given 'warnings'; offenders not afraid of consequences and certainly have no fear of the police.
    Thirty-five years of hard labour and confinement in a prison like maybe you'd find in Turkey, followed by prompt deportation, would soon put a stop to this terrorism.   No, I'm not kidding.  Nobody should have to wake up to the living nightmare that is a violent invasion by African terrorists in their own home, let alone ordinary suburban people with no guns and no combat experience to rely upon to handle this menace.

    A former Australian army chief has warned Canberra against “blindly” following the United States in the American military adventures, a day after a long-awaited inquiry into Britain’s role in the 2003 US-led invasion of Iraq blamed the UK for rushing to war.

    “We... need to be careful of blindly going along with our senior strategic partners,” Peter Leahy, who was the chief of the Australian army from 2002 to 2008, said in an apparent reference to the US.

    “I think as we look at other issues that are afoot at the moment, there are some thoughts to be given there — what decisions are we making?” he said, speaking on Thursday.

    The former army chief, who is now a professor at Canberra University’s National Security Institute, added that “Frankly, some of the decisions the United States, our senior partner in our strategic alliance, have [sic] made over the last 20 or 30 years have been a bit crook.”

    The Chilcot Inquiry, established in 2009 to investigate Britain’s most controversial military engagement since the end of the Second World War, published its 6,000-page report in 12 volumes on Wednesday, slamming former British Prime Minister Tony Blair over support for former US President George W. Bush in the 2003 Iraq war.

    At the time, Blair presented the case for war with “a certainty which was not justified” based on “flawed” intelligence about Iraq’s supposed weapons of mass destruction (WMD), which was not challenged as it should have been, the report concluded.

    Blair’s government sent 120,000 members of the British armed forces and civilians to Iraq, proving its role as Bush’s chief military ally.  A total of 179 British personnel were killed in the war.

    In 2003, Australia also sent 2,000 troops to support the US and British forces in the invasion of Iraq, whose legal basis, according to the Chilcot Inquiry, was “far from satisfactory.”

    According to Leahy, a review of the Australian involvement in the Iraq war released in 2004 also showed that Canberra relied on flawed advice in joining its senior allies.

    Let’s have a discussion, not an inquiry, around our relationship with the United States, how we decide to go to war and very importantly how we decide every day when we are at war to stay at war,” Leahy said.

    Meanwhile, Australian Foreign Minister Julie Bishop, who at the time of the Iraq invasion was part of then-Prime Minister John Howard’s conservative government, defended the decision made by the government to send troops to Iraq, saying it was “based on… the best information that we had at the time.”

    “The government takes responsibility for all decisions that a government makes and we take responsibility for this one,” she further said, describing the decision as “a bipartisan position up to a point.”

    Blair himself has defended the British decision to follow in the US’s footsteps into Iraq following the publication of the Chilcot report.

    According to the Australian constitution, the government does not require a permission from the country’s parliament to declare war.
